These Terms of Use govern your access to and use of Pinegrow Online, including the browser-based editor, account pages, billing flows, websites, APIs, and related services provided by Pinegrow Pte. Ltd. By using Pinegrow Online, you agree to these Terms. If you do not agree, do not use the Service.
Definitions
Company, we, us, and our mean Pinegrow Pte. Ltd., 30 Petain Road, Singapore.
Service means Pinegrow Online and related websites, editor features, account services, billing pages, APIs, and support channels.
You and User mean the person or organization accessing or using the Service.
Content means projects, files, code, text, images, media, metadata, and other material that you upload, create, store, edit, publish, or share through the Service.
Accounts
You may need an account to use paid features or cloud storage features. You agree to provide accurate account information, keep your credentials secure, and notify us if you believe your account has been accessed without authorization.
You are responsible for activity that occurs under your account and for ensuring that anyone using the Service through your account complies with these Terms.
Subscriptions and Payments
Paid Pinegrow Online plans are offered as recurring subscriptions. Prices, billing intervals, taxes, and renewal terms are shown before checkout.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for paid orders, handles payment processing, and provides customer service for payment, tax, and return inquiries.
You may cancel a recurring subscription at any time. Unless stated otherwise during checkout or in writing, cancellation stops future renewals and your paid access continues until the end of the current paid period.
The yearly Pinegrow Online subscription includes a 30 day money-back guarantee, subject to our separate Refund Policy. Taxes such as VAT may apply depending on your location and Paddle's checkout rules.
Acceptable Use
You agree not to use the Service to break the law, infringe the rights of others, distribute malware, attack or disrupt systems, scrape or overload the Service, attempt unauthorized access, or publish content that you do not have the right to use.
You may not reverse engineer, bypass technical limits, abuse trial or guest features, or interfere with security, billing, rate limiting, or access-control mechanisms.
Your Content
You retain ownership of your Content. You grant us a limited license to host, process, store, display, transmit, back up, and otherwise handle your Content as needed to provide, secure, maintain, and support the Service.
You are responsible for your Content, including code, assets, dependencies, and any third-party rights or licenses that apply. If you choose to publish or share a project, people with access may view or use it according to the sharing settings you select.
Our Software and Materials
Pinegrow Online, Pinegrow Web Editor, the user interface, documentation, templates, designs, trademarks, and related materials are owned by Pinegrow Pte. Ltd. or its licensors. These Terms do not transfer ownership of our software, brand, or materials to you.
Third-Party Services
The Service may use third-party providers for authentication, hosting, storage, payments, email delivery, analytics, customer support, and other operational needs. Your use of third-party services may be subject to their own terms and policies.
Links from Pinegrow Online to third-party websites are provided for convenience. We are not responsible for the content, policies, or practices of third-party websites.
Termination
We may suspend or terminate access to the Service if you violate these Terms, create security or legal risk, fail to pay fees when due, or use the Service in a way that may harm the Service, other users, or third parties.
You may stop using the Service at any time. Some provisions, including payment obligations, ownership, limitations of liability, disclaimers, and dispute provisions, will continue to apply after termination.
Disclaimer
The Service is provided on an "as is" and "as available" basis. We do not promise that the Service will be uninterrupted, error-free, secure, or suitable for every project or purpose.
Limitation of Liability
To the maximum extent permitted by law, Pinegrow Pte. Ltd. will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from your use of the Service.
To the maximum extent permitted by law, our total liability for claims related to the Service is limited to the amount you paid for the Service during the twelve months before the claim arose.
Governing Law
These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. If a dispute arises, you agree to first contact us and try to resolve it informally.
Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users. Continued use of the Service after an update means you accept the updated Terms.
